Los Angeles County District Attorney Nathan Hochman has decided not to pursue the death penalty in the criminal case against Nick Reiner, according to TMZ.
The decision was influenced in part by the views of Nick's slain parents, Rob and Michele Reiner, who were against the death penalty.
Before his death, Rob Reiner, a Democrat who was outspoken about politics, praised Erika Kirk for forgiving Tyler Robinson, the man accused of killing her husband, Charlie Kirk.
Another factor was the impact on Nick's siblings, Jake and Romy Reiner, who would face a difficult sentencing if their brother's execution were possible.
Jake and Romy are not aligned with Nick and have already decided not to fund his defense.
A 2019 order by Governor Gavin Newsom that halted the death penalty for 737 planned executions also played a role.
Newsom said the death penalty was "unevenly and unfairly applied to people of color, people with mental disabilities, and people who cannot afford costly legal representation."
California's last execution on death row was in 2006, though people have still been sentenced to death in recent years.
Despite removing the death penalty, prosecutors are still pursuing Nick for first-degree murder with special circumstances -- lying in wait.
That means he could still face life in prison without the possibility of parole.
Nick was arrested for allegedly murdering his parents on December 14, 2025, inside their Los Angeles mansion, as TMZ previously reported.
