Former Olympian David Hearn is pushing back against President Trump's comments about his case, urging the court to dismiss the vandalism charges for good.

In new legal documents obtained by TMZ, Hearn argues the case against him has always been political and lacks strong evidence.

He says Trump's continued rhetoric only adds to his concern.

Hearn's request comes after Judge Jeanine Pirro moved to drop the charges without prejudice, which would allow prosecutors to refile later.

Hearn wants the case dismissed with prejudice, permanently closing the matter.

He says Trump's public statements, including claims that Pirro "choked" under pressure, show that the case is being influenced by politics rather than facts.

Hearn also points to Trump's veiled threats about Pirro's job as a reason to distrust any partial resolution.

Without a complete dismissal, Hearn says he remains exposed to continued harassment, from Trump on down.

The former Olympic canoeist was arrested after reaching into the Reflecting Pool at the Lincoln Memorial.

He was later indicted by a grand jury in Washington, DC, Superior Court.
