Puka Nacua is trying to postpone a key witness's deposition in a lawsuit where he is accused of biting a woman.
The accuser, Madison Atiabi, claims his legal team waited until the last moment to object.

According to court documents obtained by TMZ Sports, Atiabi wants a judge to allow witness Zoe Harvey to testify remotely on Friday as planned, despite Nacua's objection.
Harvey could be a crucial witness. Atiabi says Harvey witnessed the alleged New Year's Eve biting incident and its aftermath.
She is believed to have taken one of the first photos of the bite mark allegedly left on Atiabi's shoulder.
Atiabi states that Nacua's legal team had 17 days' notice but waited until Monday to object, claiming one of his attorneys had a mediation conflict.
Her lawyer calls it the "oldest trick in the book," noting that Harvey already cleared time from her full-time job and graduate school schedule to testify from the East Coast.

Nacua's camp denies avoiding the witness, saying they simply cannot make the date.
His attorneys claim Atiabi's lawyer chose Friday without checking their schedules and insist there is no reason the deposition cannot happen another day.
The defense offered to hold the deposition over the weekend or after September 7 and wants both sides ordered to agree on a new date.
As previously reported, Atiabi sued Nacua in March, alleging he bit her shoulder during a New Year's Eve outing and made an antisemitic comment at dinner.

Video obtained by TMZ shows Atiabi twerking near a passed-out Nacua later that night.
Nacua's side admitted to the bite but described it as horseplay.
Regarding the alleged comment, his attorney Levi McCathern insisted there were sober witnesses who denied the words were ever uttered.
Atiabi initially sought a temporary restraining order against Nacua but later dropped the request to focus on her civil suit.
Nacua checked into a Malibu rehab facility for "personal growth," which his attorney said was unrelated to the allegations.
