Carmine Agnello, the grandson of Gambino crime boss John Gotti, is asking a federal judge to postpone his prison sentence so he can donate a kidney to his mother, Victoria Gotti.
Federal prosecutors have expressed skepticism about the request.
Agnello is scheduled to surrender on Monday to begin a 15-month sentence for defrauding the federal government of $1.1 million in COVID relief funds.
He has requested a 60-day delay to undergo kidney donation surgery for Victoria, who suffers from chronic kidney disease.
Two doctors' notes confirm a transplant date of August 3.
Prosecutors responded in court filings, stating they are willing to agree to the delay only if the donation actually occurs.
They noted that a previous transplant was scheduled for March but never happened, fueling their doubts.
The government proposes an August 10 deadline: either Agnello donates the kidney by then or surrenders to authorities.
If he fails to donate, prosecutors request that no further deferments be granted.
In addition to his prison sentence, Agnello was arrested last month on charges of choking his girlfriend.
